Terms of Service
Effective date: 1 April 2025
1. Acceptance of terms
By accessing or using the NestifAI platform ("Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform. NestifAI Pty Ltd ("NestifAI") reserves the right to update these terms at any time with reasonable notice.
2. Eligibility
You must be at least 18 years of age and have legal capacity to enter contracts under Australian law to use the Platform. By registering, you represent that these conditions are met.
3. User accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate registration information and keep it up to date.
- You must not share your account with others or use another person's account.
- NestifAI may suspend or terminate accounts that violate these terms.
4. Listing content
Agents and landlords who publish listings on the Platform warrant that:
- All property information is accurate and not misleading.
- They hold the necessary licences required under applicable state real estate legislation.
- Images and descriptions do not infringe third-party intellectual property rights.
5. AI-generated content
Match scores, suburb insights, and search results are generated by AI and are provided for informational purposes only. They do not constitute financial, legal, or investment advice. You should conduct your own due diligence before making any property decision.
6. Payments and subscriptions
Paid features are billed through Stripe in Australian dollars (AUD) inclusive of GST. Subscriptions renew automatically unless cancelled before the end of the billing period. Refunds are provided in accordance with the Australian Consumer Law where applicable.
7. Prohibited conduct
You must not:
- Use the Platform for unlawful purposes or to harass other users.
- Scrape, crawl, or systematically extract Platform data without written consent.
- Attempt to circumvent security controls or access another user's data.
- Post false, misleading, or fraudulent property listings.
8. Intellectual property
The NestifAI name, logo, platform design, and AI models are the intellectual property of NestifAI Pty Ltd. You may not reproduce or use them without prior written permission. User-submitted listing content remains the property of the submitting party.
9. Limitation of liability
To the extent permitted by law, NestifAI's total liability for any claim arising from use of the Platform is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or economic losses.
10. Governing law
These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
